These Terms of Use (the "Terms") govern the rights and obligations relating to the use of the Futba mobile application (the "Application"). By accessing and/or using the Application, the User is deemed to have read, understood and accepted these Terms in their entirety.

1. Description of Service

Futba is a social matchmaking platform that enables users to organise football matches, join existing matches, and communicate with other users. The Application provides a technical infrastructure that facilitates interactions between users; it is not a party to the actual conduct of any match.

2. Account Responsibility

• The User shall be solely responsible for the security of their account.
• The User undertakes to provide accurate and up-to-date information to the Application.
• Accounts may not be transferred, leased, or otherwise shared with third parties.
• Users under the age of thirteen (13) are prohibited from using the Application. Where such use is identified, the relevant account will be terminated without delay.

3. Rules of User Conduct

The following conduct is strictly prohibited within the Application:

• Harassment, insult, discrimination or any threatening expression directed at other users.
• Creating fraudulent accounts or accessing the Application by impersonating another person.
• Sharing spam, advertising, or unsolicited content.
• Sharing content that is unlawful, obscene, violent or otherwise harmful under applicable law.
• Providing intentionally misleading or inaccurate information when organising a match.
• Reverse-engineering, modifying, or creating derivative works of the Application.

Where a violation of the foregoing is identified, the relevant account may be suspended or terminated without prior notice.

4. Match Organisation and Liability

• The organisation of and participation in matches takes place directly between the users.
• The Data Controller shall under no circumstances be held liable for any injury, property damage, dispute, or comparable incident that may occur during a match.
• Match fees and payment arrangements are determined exclusively between the users; the Application does not act as an intermediary or collect any payments.

5. Premium Subscription

• Futba offers an optional Premium subscription that provides access to additional features. This subscription is an auto-renewable subscription billed on a monthly or annual basis.
• The subscription fee is charged to your Apple App Store account on iOS, or your Google Play account on Android, at the current price displayed within the Application at the time of purchase. Payment and billing are handled by the relevant app store; Futba does not store your payment or card details.
• Unless cancelled at least 24 hours before the end of the current period, the subscription renews automatically for the same duration at the then-current price.
• You may manage or cancel your subscription at any time from Settings → (Apple ID) → Subscriptions on iOS, or Google Play → Subscriptions on Android. Cancellation takes effect at the end of the current period, and no partial refund is provided for the current period.
• Refund requests are subject to the prevailing refund policies of the relevant app store (Apple/Google).
• The subscription set out in this section relates to the Application's own Premium service. The match fees referred to in Section 4 are payments determined exclusively between users, to which Futba is not a party, and are independent of this subscription.

6. Content and Intellectual Property Rights

All software, design, logos, trademarks and other content embedded within the Application belong to Futba and are protected under intellectual property laws. The unauthorised reproduction, distribution, modification or creation of derivative works of such content is prohibited. By uploading content such as a profile picture, the User grants the Data Controller a non-exclusive, worldwide, royalty-free licence to use such content for the purposes of operating the Application.

7. Modifications to the Service

The Data Controller reserves the right to modify, suspend or terminate the Application, the features it offers and these Terms at any time without prior notice. Material changes shall be communicated to the User reasonably in advance via in-app notification or e-mail.

8. Limitation of Liability

The Data Controller does not undertake that the Application will operate without interruption, errors, or in a manner that meets a particular purpose. To the maximum extent permitted by applicable law, the Data Controller shall not be liable for any direct or indirect damages arising from the use or inability to use the Application.

9. Account Termination

The User may delete their account at any time from within the Application. Upon account deletion, the User's personal data shall be processed, anonymised or erased in accordance with the procedures set forth in the Privacy Policy.

10. Dispute Resolution and Governing Law

Any dispute arising out of or in connection with these Terms shall be governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of Istanbul shall have exclusive jurisdiction over the resolution of any such dispute.
